While it is possible to avoid these harsh punishments in most cases, many drivers minimize their chances of doing so by making major mistakes while pulled over.

If you want to have the best chance at steering clear of jail time and expensive fines for your Dallas DWI, then DON’T do the following:

  • Don’t get out of the car. Stay seated, roll down your window, and retrieve your license and insurance card from the glovebox.
  • Don’t volunteer extra information. Answer the cop’s questions calmly and directly, and don’t tell him anymore details than he requests. You never know when extra information could be used against you. However, if the officer begins asking specific questions about your evening, such as how much have you had to drink or when was the last time you ate, it is probably best to invoke your 5th Amendment right to remain silent until after you have spoken with a lawyer.  It is almost certain that if an officer is asking you these types of questions, you are already being investigated for a DWI.  Anything you say at this time can be used against you.  Therefore, it is best to consult with an officer before answering.
  • Don’t get emotional. Getting angry, upset or worked up is only going to make matters worse. Stay calm and treat the officer with respect at all times.
  • Don’t perform any sobriety tests. If you’ve been drinking, always refuse to take a Breathalyzer test. Not having blood alcohol content results on your record will help hugely in your case later on down the line. You should also opt out of any other tests the officer may request, like walking the line, touching your nose or saying the alphabet. 
  • Don’t give a statement. The officer may want to get a statement for records. Politely refuse to do so until you have spoken with an attorney. You have the right to do this, and it will ensure you don’t say anything incriminating or damaging to your case.
Ultimately, if the officer opts to arrest you and charges with a Dallas DWI, it’s time to contact an attorney immediately. They may be able to help you avoid license suspension, jail time and other harsh punishments.
